The judge as appointed an auditor to run Trump's businesses while they decide how much to fine him, and decide whether they are going to take away his business licences, Trump is supposed to tell the auditor what he's doing all the time. So, no it's not legal for Trump to do that.

Depends on 'quietly' means without fanfare, ore means 'secretly'. And also depends on whether 'caught' in this context means the auditor happened across the transaction through investigation or was notified and reported as part of their duties. If you are the owner of a company you can move funds to your personal account as a wage, - pay yourself for the work you do for the company, as a 'dividend' - your share of the profits before tax, or as a 'directors loan' - ie the company loans you money and you have to pay it back. Directors Loans can go in either direction as directors might sometimes loan their company money to assist it also. All those things are fine so long as they are documented, and the company can actually afford to do them. So you can't take out dividends greater than the pre-tax profits that leave the company unable to pay its tax bill for instance. Theres also the question as to who other than Trump owns the company - he can only take out dividends relating to his share of the profits also if you pay out dividends to one shareholder you have pay out the proportional profits to all the others at the same time.
There's a court appointed auditor whom they have tell if they move more than $5M from anywhere to anywhere else, so there's that.

I'm no expert on NY property development financing but I think it's borderline illegal.
Difficult to see the judge not giving that some weight when he decides how big a hammer to use.
I suspect it's a small enough detail not to carry much weight against the other stuff? Considering that the case has also heard examples of just plain making it up.

I bet if you were a small business owner over there and you pulled that crap you'd likely be in a fair bit of trouble.
Just like here though, I'm no longer naive enough to think we all live under the same laws, irrelevant of who we are.
I think it's more an issue for the kids than Trump. It's already been established that there has been fraud. What the court case is establishing is who in the company was complicit and how they should be sanctioned. The young trumps have all been claiming they are innocent of any wrong doing as all they did was sign stuff and trust that the accountants were doing the right and honest thing. What Ivanka (who isn't a defendant in the case, she's only a witness) is saying is that those kids actively participated - moving money around in order to create an illusion of the company's financial position. So more than simply mis-stating a financial position (saying you think a property is worth X, or in their case signing something you sat you haven't read that says a property is worth X, or the company is worth Y) but actively creating a misleading evidence. The accountants wouldn't have had the access to Trumnp family personal bank accounts to take money and let it rest in the Trump Orgs account.

It's becoming enjoyably monotonous to see legal manoeuvres by trump lawyers being continually rejected.
