[Closed] Help! Do they need a permit for close my road? Very angry content!

Utility company is digging up the footpath on my road. They have yellow signs that say 'no parking tow away' In marker pen they have scribbled the from/to dates (whole month).

Don't they need to apply and display a permit for this?

They would need to serve notice to the council under the Traffic Management Act. Not sure they need to display anything on site though beyond what they already have

At the very least, they should have a 5 day notice from the local authority which explains the powers invoked to stop you using the public highway. It will also detail any enforcement action against contravention. These notices cost the utility companies so they sometimes try it on. Ask to see their 5 day notice. If they can't show you, call the council and ask to speak with the traffic manager. While it might not be someone's exact job title, they are legally obliged to have an individual who functions as one.

Sad as it is, this is what I do for a living.

Dunno why you're complaining?

The work is probably being done for the benefit of whoever lives on the street.

Utilities dont spend money on expensive digs just to deliberately piss people off.

Somewhere in a local paper will be a notification of future road closures, and i think they have to post, on lampposts, a notification. In edinburgh they are stuck in the back of the scotsman near the adverts for washing machines.

You only have to advertise in the paper for permanent or temporary orders. A 5 day notice just goes up on site and doesn't need any warning.

If it's just the footways they're digging up, chances are the restriction will be a prohibition of waiting and loading. They will also have temporarily revoked and legal orders there like permit bays.

However, if there were no legal orders there then you have no right to park there and I assume you can use the footway on the other side of the road.

No they haven't closed the road - just preventing parking - along both side of the road for 100m (only 20m of which they are digging up). Foot path is closed for the 20m.

The rub is the closure period dates change on a daily basis and are written with a marker pen. The first dates were for a day, then 2 days. Today they have changed to a month! Obviously nothing is going to happen over the next 2 weeks of holidays. Last night they insisted they need to dig till midnight - until a neighbor had a scream at them.

All they have got out are some cones and and a few yellow signs as above.

Found out its to replace a electricity cable. 33,000 volts - i can see the exposed cables from my door

Im sure they would need to display some official notices or something.

If it's going to take more than a month, a notice won't cut it. It needs an order unless it's done as emergency works. Either way, even if it's emergency works, the paperwork should be in place by now. As for the threat of tow away, that's not going to happen without a legally enforceable sign to do it against (unless the police shift it for obstruction).

Bob, I know, but I have to assume they cant just do anything they want with no consideration for the residents.

Power cable - so emergency maybe but I bet they wont be working over the easter wedding weekends so it cant be that much of an emergency. And they were only outside for a couple of hours today.

Just perhaps park somewhere else. or get a felt tip pen and alter the dates to what you like.

33000 volts seeems a lot to go down your street, but perhaps talk nic eto the nice men andd they may let you tap into it, and get some free leccy.
