I had an accident at the end of June, I admitted full responsibility on the spot and we exchanged details etc etc.
I phoned my insurers (NFU) about 2 hours later, told them what had happened blah blah, said it was my fault.
About a month later I got a letter through from the other parties insurers informing me that they needed money off me. I thought this was odd since I assumed my insurers would be sorting it.
Phoned both companies and told them the crack and they said it would be sorted.
Another month later I get a similar letter through the post saying they would be taking court action to get the money back. Phoned both companies again explaining and the NFU told me to send them the letter and they would sort it.
Sent them the letter 2 weeks ago thinking it would be all sorted.
Got a form through the post today from Northampton County Court, I havent read it but it looks pretty serious.
To be honest I take no interest in stuff like this and know little about it, I jsut find it confusing. Just wondering what the crack is and why have I been sent some sort of claims form from a county court. Surely my insurers should be sorting everything?
Any help much appreciated.
The forms I have been sent are
N9A Form of admission
N1CPC Claim form
N9B Defence and counter claim
N9 CPC Response pack
What the hell are they?
To me it seems obvious that the two ins companies aren't talking
Your company should have been in touch with there's & told them that they would handle all the paperwork etc. - I'd bang some heads Monday morning
Yeh, thats what I presumed would happen. I've spoken to them about 3 or 4 times and they've done **** all about it.
I explained the situation last time and they told me to forward them the letter I had received.
I also phoned the other parties insurers and and they said they've written numerous letters to my insurers but with no response.
What the ****
Did you buy via the call centre (Glasgow) or one of the local branches?
Local branch.
I havent paid my excess of £100 and now I've got this claims form from a court with a £2000 bill.
Help
Is it too late to get my insurers to pay if i give them my excess?
Bang heads.
Although if i was your insurer I wouldn't pay out.
NEVER ever admit liability at the scene of a crash - leave that to your insurers to sort out.
You really need to look into how insurance works before giving money to people...
I think you might find you have no cover if you admit liability. It's really hard, but apparently you shouldn't even say 'Sorry'.
Eh, that doesnt sound right.
I have a letter from a county court, this is scaring me a little.
What can I do to get my insurers to pay?
I can assure you that it is correct.
You need to talk to your insurers and tell them that you are a bit pissed at doing their job for them.
I've had 3 minor accidents in my time. Admitted liability at the scene every time (on the basis that I'm not a **** and it was my fault!). Can't remember what I said on the claim form, but probably would have been truthful on the form. Insurer paid out every time... Granted these were all 10+ years ago. I'd like to see evidence that admitting liability invalidates your insurance.
My advice is for you to read the documents you've been sent. Then ring your insurer ASAP and ask them what the hell they're doing with your claim.
Your local branch won't have dealt with the claim. It goes thru a regional office. You can phone your local branch up / call in over the weekend and ask for the phone number of the regional office and someone to speak to but I don't think there's any point in phoning that till Monday. Then call them direct. Explain the situation and get answers on the phone or shortly afterwards by getting them to call you back. If they can't help then escalate to the senior claims manager of the regional office. If he can't help then ask for the phone number of Head Office and who you can complain to / get it sorted there.
If your policy number starts "002X" then your local branch should be able to give you the claim number and some information about the claim over the weekend.
I can't believe that admitting liability is meaningful in any way really - after all, denying liability gets you nowhere. It's for insurers to decide, regardless of what the drivers do or say, no ??
I think you might find you have no cover if you admit liability. It's really hard, but apparently you shouldn't even say 'Sorry'.
Sorry but that's incorrect, that's the whole point of car insurance, if you have a knock regardless of who is at fault they pay out. You will loose your no claims bonus though unless it's protected. Saying 'sorry' also doesn't imply liability, I know this as I had to go to court for a knock that happened 2 years ago.
