[Closed] e-bay item description accuracy

I've just bought a saddle from e-bay which was described in the listing as 'new'. When the item arrived this morning and I opened it I instantly recognised the smell of smoke damage(I'm a firefighter). A quick wipe with a sponge quickly confirmed a layer of black grime on the saddle. Other than that the saddle is new and is in it's original packaging.

Do you think the seller has breached e-bay rules by listing the item as new and not mentioning the smoke damage? If so what are my options, as I don't really use e-bay that much. I was happy with the price I paid for a 'new' saddle but I'm not so sure that's what I've got.

S'pose technically it is a new saddle, they just omitted the smoke issue, not the most honest thing to do but not sure they have lied....

contact the seller and express your concerns.

most are fairly willing to be accommodating as they don't want bad feedback.

i have had a few item s recently, no where near the condition they was described as,if your happy keep it and leave a mediocure feedback

I've managed to find something on e-bay's help pages which states:

An item is considered "New" when it meets the following criteria:

It is in the original condition from the manufacturer, distributor, or retailer.

It has not been refurbished or used for any purpose.

It has no known defects or [u][b]damages.

I had to service a Chris King headset that was described to me as excellent condition and hardly used. It was full of grit.

Once serviced it runs amazingly smooth so i have put it down to experience. Why waste time worrying about things, just make a note never to use them again.
