A friend was driving in a gym car park and accidentally scraped a car parked in an undesignated parking space. The drivers details were given to reception so if the recipient of the damage claims they can contact the owner of the car that did the damage. No damage to the car of my friend.
Should my friend advise their insurance company that there may be a claim coming through, or keep quiet until they get contacted.
As the car damaged was parked in a place they shouldn't, can this be used to protest the claim or would the 'due care and attention' over-rule this? I wasn't there and haven't seen a picture of the car park layout.
Event would seem to have taken place on private land, so you have the I'm a **** option (1), or the I'm a reasonable person (2) option.
1. Get stuffed, you can't park properly. Take me to court if you want.
2. Sorry my fault. Please get 3 estimates for the repair. If it is a small amount I will pay you directly.If it's a large amount I'll contact my insurance company and let them deal with you.

private car parks are different rules aren't they?
I'm hoping they'll notice it some time later and can't remember where it might have taken place.
the moving car will be at fault, you can't bump people for illegal/ poor parking
don't notify, wait for the call, no call, no claim, no need for them to know
Someone drove into my mrs in a car park and it went 50/50 even though she was stationary, because the other party claimed she was in an area of the car park she shouldn't have been.
There are some circumstances where a claim will be rejected for illegal parking
Many years ago I fell off my motorbike on oil on a roundabout. The bike slid into a parked car doing significant damage tot eh car. My insures refused the car owners claim on grounds the car was illegally parked and if it had not been then it wouldn't have been hit.
