When does a private car seller become a commercial entity?
Is it based on the number of vehicles they sell per year?

When they tell HMRC what they are up to?

I'd just give them a bell and ask, if you're talking about yourself.

I'm talking about someone who's advertising a known dodgy car, and has a history of selling other vehicles. Legal definition could be important to get this scam artist sorted.
I know HMRC put a figue on it, just wondered if any of our enlightened dealers knew.

From insurance stand point, he would need Motor Traders cover if he is buying/ selling reguarly.

When they buy a car with the prime intention of reselling it. A bit hard to prove, but I'd say that if you didn't register it in your name when you bought it, that's the first sign you weren't planning on using it personally.

My Dad used to work in Trading Standards, I'm sure he once said 20 was a good indicator that you're a dealer rather than just being a bit indecisive in your car buying.
