[Closed] Urgent Have you purchased parts from Euro Car Parts - catastrophic event urgent

[#5717631]

Has anyone purchased a wishbone bush bracket from Euro car parts and it has failed. I purchased this part from them in November 2009, had it fitted in March 2010 and in May 2010 it sheared in half on the Motorway. with catastrophic events. I gave them the remaining part to send off for testing, and guess what they have not only lost the part, but they have lost all trace-ability of it too, including the paperwork. I am taking them to court, but the onus is on me to prove it failed. Please ask everyone you know, please share if you can, ECP informed me that it had happened to others, they deny this now of course, but I need to find the others who this happened to. My car was a BMW convertable 2004 318ci series with M sports kit on it.

I appreciate you see this as a valid reason to start an internet campaign against euro car parts, but spamming every non related forum on the internet is just poor form.

This is not spam, you may think it is wrong, but I need to find others that experienced the same, if it was you or your family you would do the same, this is genuine.

Why have you posted here though? Have you posted on completeltyunrelatedtoanythingtrackworld as well? Why have you waited 3.5 years to post?

Linda, where do you stand on the 26", 650b, 29er debate?

Edit: I once bought some windscreen wipers from Eurocarparts, they were ace!

I'm sure you're sincere but there are better channels to take - Trading Standards or Consumer journalism (Watchdog on the BBC or various other televisions and radio channels) who'll give the issue the airing it requires and it forces an involvement from your foe. Scattergun postings on random forums is just going to be met with cynicism and - probably before I finish typing this - your post being deleted.

Don't see a problem...not like you can't tell what she's asking from the title; if you haven't bought from them, move on

Not what I would call spam so don't see why it needs reporting 😕

Thank you Nuke

I am sorry I have caused a debate, all I am asking is if others have ever had this problem, I am sorry to have caused any of you to be critical I am not creating a debate, I am looking for others who have had the same problem.

I have had no other choice but to wait, as ECP did not inform me that they had lost everything up until now, they were sorting it out. I am prepared to take criticism, but I will take that chance, I do realise I am posting n forums, but I just hope that someone somewhere will know what I am talking about.

I accept that Linda's applying a bit of a scattergun approach which is a slight nuisance but her OP's not entirely off the wall for this place. TBF car threads are hardly unknown on the STW Chat forum and STW is not exactly devoid of BMW owners.

I am sorry for being an nuisance, this is not how I want to come across, desperate measures rule over a logical approach, and I am now completely desperate, so apologies to everyone at STW, I am so very sorry for causing this debate and for any unease. I just want to find the others that has been affected.

I am sorry again.

What was the 'catastrophic' event by the way; are we talking injuries?

I appreciate that but you can only frustrate yourself if you turn this into a one woman crusade and I expect you're already amply frustrated. This forum has a large readership but the number of people who have the same model of car as you, will have changed the same part as you, bought from the same source as you and had the same result will be vanishingly small. and in all probability zero.

Focus your attention on the agencies that do this for a living. If theres been more than one failure then more will happen if all those victims tell the right person than if they all try and tell anyone and everyone

not being funny but what was the police response to this?, what did their investigation say about this part, if you have their report surely it would be some evidence???

Hi Linda. Surely your insurance company will be following this up? They will be very keen to recoup any monies they have paid out. They are better placed to pursue the supplier I would have thought.

Cuddy, that's a colloquialism for horse in the Scottish Borders.

This, and shame on those on here who have 'reported' this thread.

Best of luck Linda.

I think it's maybe the topic title that folks took offence to. Maybe "please help me to trace..." would have met with a better response?

I'm also confused. Worse tha injuries = fatalities IMO, but sounds like you avoided a potentially nasty situation!?

Firstly, I am glad you where not seriously injured.

If this is genuine why didn't you create an account profile with you're name and email address ?

You can find out if this has happened before by getting pre-trial disclosure from ECP - your lawyer can tell you this and I would be surprised if they hadn't done so already.

You will be much better served by;
Posting on specialist car forums
Contacting consumer groups, like Which ?
Contacting the AA/RAC assuming you are a member - they have dedicated legal team able to offer advice.
Contacting specialist lawyers to see if they have had other similar cases brought to their attention.

To be honest sending off the original part and doing so without having it tested first yourself is a bit naive. I assume you are after substantial damages from ECP, so there are high stakes here.

Taking them to court is going to cost you many £10,000's

Finally this is why genuine manufacturer car parts are more expensive and a quality car like a BMW costs more in the first place.

especially considering there was no accident and no injuries.

Linda, at the end of the day what are you hoping to get out of this? Money? An apology?

Indeed. The millions of miles of test, development and validation we carry out on vehicles is designed to prevent exactly this sort of thing from occuring. Unfortunately this costs money, and the OEM parts WILL be more expensive than aftermarket parts which have no, or very basic validation / certification testing on them.

So the part and any chance of proving it was faulty is lost. Presumably fully comp insurance covered the OP for damage to her car.

Surely posting the allegedly faulty part back to the other party you might need to take to court before getting your own engineer's report on it was a bit careless?

Assuming no serious injuries I'd put this in the life's too short file and move on. Taking on a big company without legal aid needs deep pockets. If the OP hasn't been able to find similar cases just by googling I'd guess there are not many about.

Linda, you should try on car forums as it's mostly arseholes on pushbikes on here. Good luck.

@DrP
Awesome! Can you ask my Ma where she put her mother's diamond broach? It wasn't in the safe and one of the girls wants to wear it at Christmas?

Nods @ jambalaya's post. I'm also at a loss to know why this is urgent, when the incident occurred over three years ago. Have you just changed lawyers to a set with a better clue about RTAs, PI & liability legislation?

Making an easily googled searchable blog post (free to do with Wordpress, Blogger etc) about it that allows others to comment on it/contact you might be easier and more effective than posting on here.

My Name is Linda Cuddy my email address is linda.mills290@btinternet.com. I am fighting this on my own, as I cannot afford solicitors fees. In response to the various questions I will answer, but I am trying to trace others which has had the same thing happened to.

It is urgent as I have a directions hearing in February and I need to find these people to act as witness, yes I am taking on a big company, they have the money I do not, I am fighting this because they have been negligible, and more importantly they are in my opinion selling something that is not fit for purpose. I have been naive but I trusted them. I had to take them to court to disclose where the part was, thats is when I found out that the part and all the paperwork has disappeared and cannot be traced.

I appreciate nearly all of the comments, the silly ones are hurtful, I am a genuine person, but all I require is to find these other people
