So quite a few vehicles and houses damaged by falling walls and trees today on merseyside, who pays for the damage to the vehicles/property, the owners insurance or the buildings/property insurers, and if your vehicle is crushed, can you then claim for a replacement vehicle off the insurance, while you look for another similar vehicle, as would be the case in a rtc.
Act of God?
The insurance of the person who owns the damaged property normally.
If my neighbours wall falls on my car and knackers it - the neighbour and their insurance is paying imho
Might get messy when it is a party boundary.......
If your car or house is damaged, you claim on your insurance, and its up to your insurance company to decide if its worth them going for recovery against the party that caused the damage (or their insurers).
You claim off your vehicle insurance. It's what you pay them for and should be quicker.
You - or your insurers recovering their outlay - can only claim against the owner of the wall or whatever if you can prove they were negligent, ie should have known the wall was unstable and had done nothing about it.
Act of God?
There is no such thing in Insurance terms.
A claim cannot be denied for this reason.
Allfankledup - ordinarily they won't. You'll only get a claim against them if you can show they've been negligent in maintaining the wall. Even then you might find they are not insured for that and you have to pursue the owner themselves which is usually more trouble than its worth, as people who don't maintain their property more often than not are not swimming in cash.
6 cars crushed in same car park today by a wall of a derelict unit shedding its external wall onto them.
also quite a few cars crushed by falling trees, some on the highway some on private property.
Back about 25 years ago my grandma was visiting and the roof blew off a (pub's) garage and deposited itself on her car.
Her insurance refused to pay out insisting it was not a road traffic accident...
