Stopped at services for a few hours.. just got a ticket through for £80.. now I have read a lot of posts on lots of sites saying this is an un-inforcable charge and is effectivly a scam by a company who cannot force the charge, I was at the Frankley Services on the M5 Moto services... So what do you know about these types of charges? btw they say, stop and have a sleep.. backhanded fekers

There is one school of thought that says if you broke their rules you should take there punishment. There is another school of thought that says you should take the advice here:

I would stick two fingers up at them and do the latter, esp if more than one person is registered as the driver of your car.

Did you miss all the signs saying 2 hours free, beyond that you have to pay?

Tell them you weren't there - it must be a cloned car & you'll get right on to the police about it PDQ

if they do think it was you - ask them to provide evidence - not of the car, of you

If you were asleep in the car, they probably have a photo of you in it 😀

They may well do but unless they see you in the flesh - how do they know it's you?

Presumably they'll spot you in the courtroom? 😀

tell them to go swing.
just don't leave your can in their carpark again as there is a slight chance they'll try and clamp you.

I saw no parking signs about neededing a ticket.. its a service station where you stop to rest!!!!!!!!!!!!!!!!!!!! plus I am on the basis I have read this company have no legal right to charge, also their letter states CCJ's & bad credit ratings.. there is no credit agreement in place so how can they effect my rating????

They don't even own the land anyway - it's government land

Don't pay, they have never taken anyone to court. You will get a few strongly worded letters then they leave it.

Is there a facility to pay? Don't recall ever seeing a meter in any of these places.

While I'm wholely on your side here:

I've stopped at Frankley - there were signs up when I stopped.
You're meant to stop and rest, not sleep overnight. 2 hours is a fair time and one could say that part of the reason it was brought in was the fact that loads of people over-nighted there when they shouldn't.

I suspect they'll leave you alone if you tell them to, but ignoring it would be a mistake IMO.

uplink - dont they lease the land from the government, so that point is moot. They rent the ability to use the land for their own ends, they choose to operate parking restrictions and the OP chose to park there for longer than the free time. He should have paid the 8 quid or left.
