I ordered some running trainers from this company just over a week ago, they often appear at the top of Googles search listings so you'd think they are a good mail order company like Asos or Zalando. I called them on Saturday and spoke to a chap who said that he'd try and put the order through again, I said that the website now says they are not in stock and he agreed they were never in stock.  He couldn't give me a time when I would be refunded and said I should contact my bank.

I spoke to my bank (Debit card) who asked me to get Pro Direct to put in writing when I'll be refunded and the last 4 digits of my card number and they could take some kind of action.  They've not replied to any emails and the online reviews are telling a similar story.

I'll call them again but is there anything I can do? Report it to my bank as fraud?  It's only £65 but they are turning over millions so I don't see why I should be out of pocket.

Id call them once more, there's no reason they cannot refund the money immediately if there's will to.

But it looks like you'll have to go down the fraud /charge back route with your bank though.

I don't see why the company failing to respond would stop the bank doing a chargeback. Speak to them again explaining that you've tried to do as they asked but received no reply.

There is no reason that the company shouldn't process a credit as they cannot fulfill the order.

I would insist that they go down this route. Failing that, then contact your bank and ask for a chargeback to be processed as @martinhutch has already said. You'll just talk to their disputes team and more than likely they'll get you to fill out a few forms. It'll automatically get charged back to ProDirect Sports, after which they'll have a chance to respond. (They cannot dispute the chargeback before it is processed)

Unless they can prove that the order was fulfilled, the buck stops with them.

A charge back can be processed on a debit card I presume?  I thought they might only be interested if it was my credit card.

Most card companies will offer it. Certainly if you are with one of the mainstream banks.

Chargebacks are for debit cards. Section 75 claims are a for credit cards.
