[Closed] Knocked off bike this morning. Advice please...

Climbing a steepish bank this morning and a car came out of a junction on the right and went straight across in front of me into the junction opposite. I went straight into the side of the car spinning my front wheel round and me falling off. Driver failed to stop. No damage to bike or me but still ****in scary all the same. I rode after the car but could not catch it. I've managed to get the number plate. Should I report it or is it a waste of time. I'm still pretty p*ssed off now.

No witnesses? don't expect much outcome but it will be recorded, the cops might well go and have a word with the driver and check him out for being legal and there will probably be an ANPR marker put against the car.

Worth doing

Worth reporting it and insisting on a visit - that's prob all the Pigs can do but they should give you a follow up adn you'll feel you've done all you can.

Then work out where the driver lives and nitromors-bomb the car 😡

I take it you had the right of way & that the vehicle in question jumped the give way markings?

I've had this done to me & the police are still investigating it. Report it at once and make sure you tell them the wheel was damaged. From my experience they aren't interested unless there is injury and/or damage done.

Ah. just seen that no damage was done to your bike.

report it and ask pold to pop around and have a look at the wheel shaped dent in the car! Driving off after an accident is an offense.

Irrelevant that isnt it, failing to stop isnt right on any level, wether your in the right or wrong on the road surely?

Failing to stop after an accident is a fairly serious offence.
Definitely report it. With no witnesses and no damage there's nothing that will happen (unless you managed to leave a good dent in the car?) because it'll be your word against the drivers.

The police should pay the driver a visit for a little chat but unless there's CCTV and/or visible damage to the car, the driver could easily say "sorry mate, not me, the cyclist must have read the plate wrong". He should however take a lot more care next time he gets to a junction...

Tinsy, being in the right if the vehicle crossed the give way lines will make your case a bit more interesting to the police. If the OP is in the wrong they may just ignore him.

Failing to stop is a crime. The police did take an interest in my case especially when the other guy hadn't reported the incident at all.

Hope your ok, you'll probably find you realise you've hurt yourelf in a few hours. It took me a while before things started to hurt.

REport it, they may have stolen the car, or used it for a crime, u might be a vital witness

Just reported it and got back from the Police. They seemed to take it quite seriously as the person did not stop and crossed two sets of give way lines. They are meant to phoning me in the next few days after they have spoken to them.

All I wanted was for them to have stopped and apologised. If I'd had been another foot in front I would have been on the bonnet and that would have been nasty.

definately not injured?

any aches or twinges get a doc to check you over, and mention to the Po-Pos

if someone doesnt stop they are either a complete **** or possibly over the limit, dodgy tax insurance etc

good you and bike are ok.

absolutely, definately report it. If the police follow up, the driver wont do it again.

My roadie frame ended up with a super steep head angle when I went over some idiot's bonnet.

My top tip for accidents:
If you end up on the ground after you've been knocked-off; stay on the ground for a while. Stay still. Take a few breaths. It's a magic way of attracting sympathetic witnesses, who would otherwise drift-off about their day.

If no damage was caused or injury sustained then it is not a 'reportable' accident contrary to Section 170 of the Road Traffic Act 1988 and therefore the driver is not under a legal duty to stop or report it. The fact that his/her car is damaged, say, makes no difference as it’s ‘damage ... to a vehicle other than that mechanically propelled vehicle’. He could be guilty of driving without due care and attention. In respect of injury however It should be noted that under s. 170 injury has been held to include shock and, given the developments in the area of assaults (R v Ireland), it would appear that psychological harm may well amount to an ‘Injury’ for these purposes.

As you have his number plate I’d personally report it, although in the absence of any other witnesses it’s very unlikely to go anywhere. You never know though, somebody may have seen his/her cretinous driving and rung it in to the police. Rocketdog’s comment is a valid point as well.

I would steer clear of advice about making damage up as in the extreme this could amount to Perverting the Course of Justice, which the courts take a very dim view of ... and if convicted people tend to get locked up regardless of their pre-cons.

While I'd be hard pushed to feel it was worth it, I'd probably report it for the sake of statistics and completeness. My brother has had a few scrapes and reported them to the police, a couple of them resulted in the police paying a visit to the person in question and damage being paid for with no further claims/process made.

Deluded - surely he still has to stop and exchange details? How does he know there is no damage unless he stops?

It’s a risk the driver takes. I understand what you’re saying but if he doesn’t stop following a collision (that he was aware of) and it’s a REPORTABLE accident as defined under the Act,- injury/damage caused, then he commits the separate offence of Failing to Stop or Report an Accident s. 170(4) in addition to any other driving offences disclosed arising out of that incident, i.e. Driving Without Due Care.

If it is REPORTABLE and he stops safely and remains at the scene for such a time as would allow anyone having a right or reason for doing so to ask for information, and he gives the required details then he complies with the law. If the driver did not give his details for whatever reason then he must report it as soon as practicable and in any case within 24 hours.

I don't think I'm talking boll*x, but I was never that hot on interpreting Traffic Law 🙂
