A friend of mine is being evicted from the house that they are renting (it is Being sold) however when it comes to handing the house back the agent has told my friend that they will walk round the house with them at the hand over but will not inform them of any faults/problems at the time but after the keys have been handed back he will then go round and take photo's of any damage and bill my friend afterwards. To me this doesn't sound right I have never rented a house apart from Armed forces married quarters and any damage/fault found at handover which are down to me I am informed of and billed or given time to rectify.

Can anybody shed any light on the correct procedure? I think that this matter is further complicated by the fact that the house belongs to the rental companys manager.

I doubt they're breaking the law doing it and no doubt they'd argue that it's because some people might threaten them if they're there in person.

If they're going down that route, I'd suggest that your friend takes LOTS of pics before leaving so that they have some proof of their own of condition.

FWIW, before I bought houses, I moved rented flats each year and just handed the keys back and waited for the deposit to be refunded. When I thought the owner/agency were likely to be trouble I just didn't pay the last month's rent (deposit was the same value) which they were never happy about but it made the arguements easier if they ever happened (though they never did).

I hope they took photos when you moved in - our flat is cleaner now than when we moved in - except for their poor paint job before i moved in ......

Cant wait to see if i get my deposit back ....

We have lots of photos

I've always gone round with the inventory checkout person, and in some instances when they've spotted something I haven't cleaned, they've allowed me to do it quickly before the keys handover.

I would expect them to go around with you and discuss anything they spot.

thier not being evicted , the landlord isnt renewing the contract and has given at least two months writen notice at the end of the rental period . when they moved it the agent would have done a walk around with them and both would have a signed copy of a condition report they agreed on showing any faults the tenants found . the two months notice gives them plenty of time to clean make good or repaire any problems .

What's the point in the the first walk round then?

How long have they lived there and is the deposit in a tenancy deposit scheme? IF they are in TDS scheme hopefully things are easier if the landlord is an arse. I have lived in 4 different rented houses and in every single one have had my full deposit returned with no hastle. Maybe I've just been lucky or is the probem overstated?

If the deposit is held by the new fangled government trust thingy, then both parties have to agree on any deductions.

If you intend to charge the tenants, the you must let them put it right first.

I fell foul of this as I had the place cleaned and tried to charge him for it. We ended up splitting the cost in the end
