[#2011870]

bought an item from amazon
said it came with accessories x, y and z

only arrived with x and y

rang them, they said that its tough, they cant supply z any more (but it is readily available if they wanted to) and offered a refund.

is it legal to advertise one thing, sell another and then when someone complains, offer a refund?
nice business model; sell as one thing, supply another and bank on a percentage of the customers not being ar$ed to send it back....

#edit# Didn't read the post correctly. Yeah, I'd be hacked off with that, where you stand legally I have no idea.

I guess it depends on the wording / smallprint. "We reserve the right to....." etc etc

Out of interest. What is the product and what are/were the accessories.

but that's not what happened - the order was partially unfulfilled

If they are giving you a refund then what's the problem? Slightly annoying but hardly a big deal surely.

If you can prove that they set out to deceive by advertising z when they could not supply it in the hope you would order then accept what you got then their actions are legally questionable. Trading Standards may say they have committed an offence. You may well be receive a full refund .

If they simply did not/could not supply what they advertised then they are in breach of contract and you should demand a full refund......oh

Guys, he's been offered a refund.

I'd go to Trading Standards if you want to take it further.

it was a ride on tractor for one of my little ones.

should have come with a digger on the front, no big deal just a bit annoying.

arrived on his birthday, so wasnt going to send it back as he was slightly keen to have a play with it.

I've seen such complaints in the reviews of a few items on Amazon. But likewise I've seen reviews with people saying "and it came with A B and C too which wasn't in the description" so on average it probably balances out. But I'd be sending it back myself, or asking for a partial refund.

You were cutting that a bit fine weren't you?
You set yourself up for a bit of a fall there or at least limited your options somewhat

Advertisers can do what they like on the internet until next year:

If you hadn't cut it so fine you could've reboxed, cancelled & told them to come & pick it up (I think). Course, then you'd have to buy elsewhere

Is part "z" an integral part of the product? Will it function as it's supposed to without the part "z"?
Do they have the right to change the product or description, see smallprint?
They are offering a refund.
You left yourself no time.

Life sucks sometimes.

works fine without 'z'.
cant send back due to:
a. my kids have used it for a week, outside, in the mud.
b. it was 50 quid and the replacement has now gone up to 180.

still happy with the purchase at that money, just less than impressed with amazon's lack of accuracy with their descriptions.

The problem with Amazon is a lot of the products are actually created by other sellers via market place. These are people that have never seen the product and are at at a desk so often descriptions are wrong. Used to work for a firm that sold on Amazon and we used to have to get in touch with them all the time to edit what had been set up for products already.

Problem is the companies so big its like trying to turn the Titanic. Top tip is if your ever buying online check the spec with the manufacturer first, then try and get the best price possible. If the manufacturer doesn't list the part but the re-seller does, sods law is it won't come with it.
