Can any of the esteemed STW'ers shed some light on the following:

I ordered the items on 16th May.
Money taken from my account on the 17th May.
Goods haven't arrived so I phoned them this a.m.
Two items, one in stock, one out of stock, due in 7 - 10 days.

Is it legally acceptable to take the money without having the goods to send?

have a google for distance selling regulations - i think they prob get 28 days to deliver (though it may be bad form to take your money up front I don't think it's illegal)

I'm currently looking now, it appears they have 30 days to fulfil the contract after the order is placed. As you say, probably just bad form.

And not the best cutomer service on the phone on a saturday either!

Its one of those "Do you want to pay 2 delivery charges or 1?" questions or is it FOC delivery? If FOC I would've sent the 1 item out by now and then forward the other later, at minimum at least of contacted you to tell you what was happening.
