Did it in september last year and now i'm moving house i have to decide what to do with the frame!
It's a trek elite 9.8 (2009)

take it to a Trek dealer and see what they say, maybe a warranty claim possible, fingers crossed

are you the original owner? if so just go to a trek dealer and ask about the warranty.

Yea they don't want to touch it, the guys in my local Trek shop didn't even want to see it.
Trek bounced it back without seeing it saying that they would sell me a slightly reduced replacement ๐Ÿ™

Trek warrenty is usually very good.
Is this crash damage or a genuine JRA?

It's genuine crash damage. I was bumped by a van who was blinded by the low light.
No other damage and the frame feels sturdy but obviously i don't want it failing on me!

so not warranty, crash replacement is the only thing trek will offer. What about claiming off the van drivers insurance, just curious why you haven't?

I did at the time and used the money to build another bike.
I kept the frame boxed up since then, i'm moving house i've got to decide what to do with it!
