Last week I had a hub repaired at the LBS (new axle, bearings, freehub body, pawls and springs) after 5km today the hub seizes when freewheeling and the locknuts and axle grind into the dropouts.
Obviously the wheel is going back to the LBS but how do I stand regarding the damage to the frame?

The damage to the frame is their responsibility.. However I'd be surprised if it was severe enough to cause an issue. Bring it to their attention and have a think about whether you want to push the issue with them. Can you post some pictures?

At best you could request some part of the repair cost back. I doubt very much they will refund you in full. Its always possible that a part has failed which has resulted in the issue & not something they have done.

unfortunatley the good wife has gone out with the camera, but the damage is quite severe, the axle ground out a slot almost 4mm deep into the dropout and the locknut has taken out 2mm off the mating face.
If it had just removed the paint then I could live with it but this is a bit more than that

Crikey! They might take issue with how long you rode it after it had failed, but that's a hard one to quantify. Either way, their work should be covered by a guarantee. As Jamie says, you need to know how it failed but if a part they fixed failed within 5km then it's their responsibility in any case.

Just take the lot in, don't talk until they've offered something.

Then consider their offer.
