I saw a listing for some MTB shoes & the listing had them down as size 8 & further down UK men's size 8. As I'm a size 8 I bid on them & won.
The shoes turned up & I try them on - well I couldn't get them on as they are a size 7 or 7.5 at the most. I then checked the label against another pair of the same make of shoes I have & although the label says UK 8 it also says EU 40 rather than EU 42 if they were a genuine UK size 8 - see pics.

I contacted the private seller & pointed out that the shoes are not a UK size 8 as described, I will send them back to them & I wanted a full refund.
The comedian then comes back to me saying the eBay listing states - Please research if you require further details.These were a gift, wrong size, worn once...near new ! "
plus - Shoe Labels say 8, basis of bidding, questions welcomed !
Also, eBay option policy option of ' no returns' !
I should point out the the listing did not state ' Shoe Labels say 8, basis of bidding,'. After looking @ eBay's site I've drafted a considerate reply pointing out that the item was 'not as described' the shoes being not a UK size 8. I am asking for his/her return address for the shoes & a full refund.
I'm a little concerned that he/she had the 'No returns' option on the item & as such I'm shafted.
Any experiance, thoughts & humour appreciated on this issue. Am I in the right or do I have to suck this up & sell them on again myself?
