    is it not more of a case of ‘passing off’ than copyright breach ?

    To use the McDonalds argument, you are accruing a benefit by allowing the customers (mistaken) belief that you are associated with the McDonalds brand. I.e. aligning yourself with a reputable company saves you time/expense in building a reputation which the other brand has spent time/good money doing so and you benefit financially from this ‘confusion’.

    Not my field of law but my view would be that its a practice to be best avoided. (Obviously direct copyright breach is also another issue.) Worst scenario is you spend time building your brand and possibly producing product with your logo and then have to start again at a later date because the other logo owner brings an action.

    Not my area so dont flame me , just thought it might add.

    +1 for companies house

    you will have to pay for the information you require if you want directors names.

    For free it should tell you holding company and its registered address which is always a good place to start corresponding

    I have medium and am 5’11”.

    Does feel a little shorter than normal but I run a flipped 125mm stem with flat bars.

    would buy a large next time.

    agreed it doesnt have to be serious(got caught up in the moment there) but would have to be worth £1000(fast track) to be worth botherin (you will know what I mean and why)

    Eliminator – ice cream run I think.

    We call it elimiator from when Bolton Mountain Bikes ran a duel eliminator from the Pike down to the car park…..with Peat,Longden et al in attendance.

    This is no definitive answer as there are too many variables.

    1.public or private land
    2. was claimant invited onto premises or not (visitor ..postman??)
    3. does land owner identify risk (often safer legally to ignore a risk as opposed to identify one and not deal properly)
    4. is risk real and serious injury foreseeable
    5. does owner deal with risk sufficiently

    claims succeed or fail on the facts and are generally brought under the Highways act or Occupiers Liability act.

    Despite above posts a vast majority of these claims do succeed.

    Lowey, was out with KKF , was getting shouted at by dog walkers who were probably up there for the first time this year and thinking they owned the place.

    I’d love to know what your expectations from this are.

    Wiggle may offer to pay for a bleed from your LBS but you wont use them.

    The cost of sending back the whole bike is prohibitive and time consuming.

    Someone from wiggle isn’t gonna turn up at your house with a pack of biscuits and some tools.

    I’d just bleed it and sit there in the knowledge that you’ve still got a bargain from a mail order shop. You could have bled it by now……

    (and dont go on about ‘rights’ and ‘legally my position is’ etc etc )

    Be pragmatic, bleed it, forget about it , ride it and only ever use your LBS going forward. They’re my thoughts.

    Mikey74 – next years worlds is tailor made for cav.

    Also – he won Milan San Remo – one of the longest classics with a few ‘lumps’ near the end. If he targets the worlds (which he will) he clearly has the ability to win it. Only thing stopping him may be too small a GB team compared to French/Italians/Spain etc.

    Not saying he will win next year but its his best chance as he wont be in the mix the follwing year in Italy.

    If Freire,Hushovd,Boonen,Cipo can all win from sprints in the last 10 year then I’m sure he has a chance – would love him to do it.

    cav needs to win worlds next year. Not sure he can keep winning as many tour stages as he does, especially given the points reshuffle.

    Nailed on if he wins worlds …like the late great Tommy Simpson.

    Agreed that Westwood would be good – still needs to win a major though.

    Macdowell’s had an amazing year though

    Got a carbon scott scale 30 – been on here before harping on about how good it is. Best MTB I have owned. Strong as ****, lovely ride. Way more than just a race machine.

    Is it me but the ARTICLE states that she is only answering to a charge of abduction . . . . . I am aware of what she was origninally charged with but the fact that the original charges have not been formally presented seems to have been ignored. Never let the facts get in the way of a good story. Me thinks there may be more to this than than press are reporting.

    Would be great if these things were reported after conviction/sentancing…then again, probably wouldnt be reported then.

    Will depend on insurance company and whether they want to insure the risk.

    some insurers will underwrite this sort of risk but the additional cost is often prohibitive.

    Will also depend on what sort of mileage you intend to cover and the value of the vehicle you are borrowing.

    May find that an insurer will think that you might be a risk due to potential high mileage in an unfamiliar vehicle on unfamiliar roads.

    There is a cost to the claimant in bringing the small claim (variable issue fee). May recover issue fee and and also some fixed costs upon conclusion(this wll be less than £100 and at the judges discretion).

    Judge MAY award ‘expenses’ to the defendant if he has been dragged to court and case against him is not proven. These are usually minor and are Expenses and not costs. Claim has to over £5000 for court costs to become applicable (fast track), thats when it gets expensive for either/both sides.

    Small claim issue fee varies depending on amount claimed. If you win and he doesnt pay then additional enforcement/bailiff costs need to be taken into account. Thats provided you can prove your case legally and the onus is on the claimant to prove a case, not the other way round.
