I’d go with a Mondeo every time. The mondeo is vastly bigger, much more reliable and the Nissan will have a poor resale value and the diesel are equipped with renault engines = lose/lose situation

Specsavers and Boots both sell glasses/contact lens cleaner (NB not saline) in a spray bottle, use with a micro fibre cloth that I use on nothing but plasma and mac screen. Used them for years and use them on motorbike helmet visor too as they don’t have salt in them which causes micro scratches.

sue the claimants advisor, he/she should have PI insurance for just such a situation

    You mean defendants??

I’m a salesman and as such have experienced various efforts by companies over the years to get rid through the back door. It’s too easy to move the goal posts and after a three month ‘performance review’ and then out the door you’re shoved.

I’ve just left a job last week after a three month performance review and it resulted in me challenging them to either make me redundant or fire me for a valid reason. I was taken on two and a half years ago a salesman in a team of three covering the North. The most senior member wanted to grow the territory and get some extra responsibility so put a case forward to bring on another member (me) and elevate himself to a position of more responsibilty and have a crack at parallel markets.

F-Fwd to 2011 and the business has reduced it’s headcount from 400 to 300, turnover down from £29m to £15m and every single dept but external sales has had a reduction in personnel. My oppo who wanted the extra responsibility is doing really badly (I’ve just done 140% of my quarterly target) and the sales manager calls me in to bollock me for daring to stand up to him in a sales meeting where he wanted to rip strips off me for an issue I had no involvement in. During this meeting (in April) he then put me on a performance review. I had to log all my appointments in a visible calendar, after each appointment I had to write a call report in the notes part of the appointment, add in travelling time etc and basically account for every minute of every day.

Three months running I had a meeting to review and every meeting my ‘working style’ was decimated and basically was told I couldn’t do the job i’d been doing for three years. Never once was sales Vs target mentioned (I was behind target year to date but the whole team of 13 are) and at the last meeting the dirty tricks came into play.

I thought for some time that they wanted to get rid of me to give my oppo his old role back, he’s been there 17 years and due to redundancy laws if they got rid of me and then sent him into my area that would be breaking the law as you have to make the position redundant and not the person. I was now witnessing them putting substance to my fears.

All of our cars were fitted with trackers for ‘health and safety’ reasons  and we were assured by the MD we would never be spied on . My boss queried why I had a 3pm appointment in my diary and I didn’t attend it as the tracker showed I had gone home early, this was simply a case of it being cancelled but he accused me of falsifying records and then dug out another appointment that I had which was in the same town as a major competitor and then suggested I’d had an interview with them!!!! 8O

He then again said he was left with a dilemma, he had no faith I could do the job so I had the option to either plough on and risk being put through a disciplinary procedure which WOULD end in dismissal (for what he wouldn’t answer) or I could resign. I explained I had income protection insurance and wouldn’t resign because a) i had no reason to and b) couldn’t as it wouldn’t pay out if I did. He then hinted at a third option which was compromise agreement and then we agreed to sleep on it over the weekend.

I called him back and said lets meet and we did the next day. He offered me a package that was equivalent to three months pay, plus £2k for loss of car and I could work for the remaining 25 days of the month and pocket commission from that month. I was on holiday the week after the meeting (I even changed from two weeks to one as I was worried about the impact of not being at work during this performance process, basically sent the rest of the family to Cyprus without me and lost the cost of my flight).

We shook hands and the week after I was on holidays I had the agreement signed and checked by solicitor and within an hour of doing it they announced another redundancy programme. I knew all along what they were trying to do and simply had too much pride to let the competition find out they were letting sales people go.

I took my company car back as agreed on the last day of August and the severance cheque I was promised was nowhere to be seen. I was told it would be posted after a P45 and commission/expenses for august calculated. The very nicely deducted a weeks pay as my holiday entitlement was pro rata’d and my holiday entitlement was exceeded when I had the week off!!

My solicitor said I had a clear case in the tribunal but what they offered me was quite good and the money would be now instead of about 12 months down the line after a load of grief…..

I felt relieved when it all ended after three months of stress but I’m now unemployed and the income protection insurance are refusing to payout because I mutually agreed to leave, even though I was obviously pushed.

So this week I’ll be mainly be filling out small claims court forms….

If the company advised you throughout and that advice left you in an ET, did they not underwrite the advice ?

if the situation was handled properly that should’ve been the case

and if the company cant pay, staff loose their jobs as the company is bust,

translates as = I’ll wind the business up to save paying the £11K but only after I’ve drained the company of assets

schwalbe 29ers are the best big hoop rubber out there, maxxis tend to explode in a sea of spaff if you give it some when using stans or joes rims

ironically I went down hard on Racing Ralphs as the TLR tyre came off a TLR monty rim with monty rim strip. Replaced with ardents, cross marks and ignitors(on 2 bikes) and whilst they are expensive they fit beautifully and are noticeably stronger without any weight penalty

geordiemick00 – I’m not sure you can insure against tribunal claims? I know you can insure against your legal costs (not necessarily value for money). But I can’t imagine being able to insure against a compensation payment to an employee. If an insurer were to offer such cover you would have to demonstrate that your policies / procedures were robust enough to withstand a tribunal; and since most tribunals are really about not following procedures you would be liable anyway (as an insurer wouldn’t cover you for deviating from the agreed risk profile).

you’re absolutely correct in what you’ve said, but I fail to have sympathy for employers who can’t be bothered to run a ship shape business and to pay to protect themselves from the swathes of people looking to exploit loopholes.

I’ve been major league shafted twice over the years by employers who CBA to do things the correct way and take their chances, so I refuse to feel sorry for them when they have to pay up. Threatening to lose other workers as a result is as low as it gets too. Getting to a tribunal isn’t easy and there’s no smoke without fire.

Surely as a responsible employer you would have had businesses insurance that would cover you for this?

I won’t say much more as I’m about to post another post regarding a company who managed me out of the business made me redundant and my true feelings will come out.

detachable tow bar with bike rack, not the cheapest option but keeps bikes/racks away from paintwork and allows hood to operate, like we have on our 9-3 vertible

I have a Hope 4 on my bars and a Hope 2 on my Helmet, not the cheapest configuration but they work, don’t need to be tampered with and have been faultless for two years until I damaged the connectors. Sent back to hope and returned within a couple of days fixed FOC.

Just don’t get this obsession with buying cheap stuff from asia and fiddling with them, it gets nasty when I light fails whilst bombing down through some woods at night I presume, or do we all simply ride canals at night??

I wonder how many people try and make their own cheap tyres, brakes etc???

i’ve heard rave reviews about SLX’s too, I’m a formula fan myself and Merlin have had some seriously good deals on The One’s which are awesome. I’ve got the ones and RX1’s but they don’t like superstar pads too well, sometimes the SS pads are a hint too thick.

Kahn seem to specialise in selling over priced vulgar motors to predominantly wealthy asians around bradford. Most people would rather work for Gadaffi than anyone or anything related to the ‘brand’ that is Kahn. They have an extensive property portfolio too and are quite well off to say the least (on paper)

Thanks guys, after spending 15 minutes on hold to virgin (on my mobile as the kids keep forgetting to put landline cordless phone back on charger ) I had a thought all of the password stuff would be in the modem so hung up and checked back here and you’ve confirmed what I suspected.

Plugged in new router, set up security settings and working a treat.

The previous router wasn’t encrypted and found an alarming number of people (presumably waiting at the bus stop across the road) had been using it.

So I couldn’t think of anything more relevant to name the new SSID other than ‘HelloBusW&nkers”!!!

Love our Saab Convertible Aero, took it up to Scotland with three dogs, two adults and a child and three bikes on detachable tow bar. Not the vauxhall as many people claim they are and coming up to three years old now and not a problem at all.

the comparison sites have had their day, google ‘Adrian Flux’ for a good deal – tell them I sent you

be careful with them, twice I’ve bought insurance through them and the policy ‘delivered’ wasn’t what the policy I’d asked for on the phone. The first time it cost us dearly as they removed our NCD protection to get the price down to where we wanted but didn’t tell us and only after a Police car ran the misses off the road on a blind bend on the wrong side of the road was when we found out the NCD protection had been removed.

the CMT927 is an excellent bit of kit, has party function so you can temporarily override the temperature for a bit, holiday function to switch everything off for a period of time and then resume normal cycles for you coming back and the unit once fitted learns how to ‘ramp up’, so for example if you want the room to be 23 degrees at 7am it learns how long the room typically takes to warm up and in due course will set the timer to put the heating on just long enough to get the room to temperature for the selected time.

I used to get a lot of technical calls from people saying the heating came on at 6am when they set it for 7am and it was just the system learning what ramp up times it needed.

I used to be a Specification Salesman for Honeywell and wireless CH is the dogs danglies! I stole, sorry, forgot to give back some samples and zoned my house using CM Zone kit. The frequency honeywell patent is unique to them , FIFO (fast in fast out) and doesn’t clash with anything like door bells, WiFi etc and is ultra reliable and used in other products such as CCTV, Security and life critical systems.

The wireless range is pretty strong too, I’ve tested systems in houses which have huge thick walls and ten bedrooms and managed to locate the transmitter in a place where all TRV’s still got good signal. When you buy the kit lay it all out in each room and test before you fit, if it don’t work they’ll still be saleable, they won’t if you fit them to the rads and then discover.

I had a four bed detached house and it meant I could zone the house so in winter only the room I was working in was heated and I wasn’t paying to heat the rest of the house. You won’t save massive amounts on your bills but the boiler works less to only heat one zone than a whole house.

I’d remove all your radiators, flush them through with hose pipe, but back on and re-fill system with furnox and new TRV’s and you’ll feel difference.

Pretty sure if you take voluntary redundancy then they won’t pay up.

I didn’t, they squeezed me out because they knew if they made me redundant my counterpart who works the same patch would have to be included in the redundancy review and that takes time and money and as soon as I’m gone they would have him cover my accounts, which is illegal. You have to make the position redundant not the person.

So they went for the option that costs a little bit more but exonerates them from any liability of me suing them for unfair dismissal etc.

As part of the compromise agreement they pay for me to see a solicitor of my choice to review the agreement and the solicitor said what they were doing was wholly illegal but it was my choice wether to take the money now or fight it out over a long drawn out tribunal…..
