Good luck if the mistake had been in the opposite direction and you only noticed after you’d signed the contract.

For the same reason I’ve never had PPI, I read the small print and T’s & C’s, I’ve been burned in the past. But the information that caused this whole debacle was never put before my eyes, so you expecting me to be a mind reader too?

Because he has history on here of slightly dodgy dealings – at least twice to my certain knowledge so people remember leopards rarely change their spots…

Seriously? Because of the Lings cars thing people have this perception that I have had ‘dodgy dealings’. What you forget about the debacle was the person who was arranging the lease, was also trying to force a contract that was unenforceable.

I’ve been in sales for 26 years and NOT ONE thing I’ve ever sold has ever been brought into question, not one.

Not one of the dozen or so bikes I’ve sold in the last ten years has ever been an issue, a fair few of them through the STW community. I must have sold £12k of bikes in that time, once the bike has been sold I’ve not had the slightest noise of disappointment or complaint.

Just like the car I’ve just traded in, anything I’ve shifted on has been looked after. sold at the right price and in a very transparent manner.

I’d be annoyed at the false accusation as much as anything, but I’m a little surprised and disappointed even, do we not let anyone off a genuine mistake any longer. Just because it’s a garage or a company, the attitude of ‘tough shit, your problem’ doesn’t sit that well with me.

So I should have just rolled over then and offered them the £3k they claim they’re down?? I wish I was rich enough to be that spirited.

What do the keys matter, that’s not the reason cited. If he’d said “the sales manager said they couldn’t check the odometer because I didn’t leave the keys” that’d be different. (And would still have been their fault for not insisting, of course.)

and he admitted today he was wrong because he’s now checked the CCTV and not only seen that they could have, but they didn’t. Nor did they check it again when I went to pick the new car up.

But I don’t understand where your sudden innocence comes from, it looks like the opposite.

pardon? My stance has been the same from the minute I walked into the showroom. I told her the correct mileage, she’s wrote it down wrong and clearly when she’s realised she’s got it wrong, she’s then tried to blame me.

They’ve had three opportunities to check the mileage and didn’t.

Today they admitted that it was ALL their own fault.

So currently the dealer is sat on £1400 of OP’s money, which should be used as deposit on the new car. Are you worried OP that the dealer will ‘keep’ this money in lieu of the difference in valuation on the Merc, rather than apply it as deposit on Volvo or return to you?

Exactly this. They have assured me that they’ll return the money when I bring in the new log book for the trade in.

So really, what you’re saying is you went off too soon until they’d had a chance to check it, now they’ve checked it it’s all fine so this whole thing was a load of fuss over nothing?

I had a cooling off period on the new car, why would I sit around and wait and reduce my options?

Someone called me up and categorically stated I’d provided them false info, I wanted it cleared up ASAP as they’re sitting on £1400 of my money.

    geordiemick00

    It’s not clear what this £1400 is…

That’s the difference of what I owed on old car Vs the trade, which they will return to me when I give them the new log book with the original car reg.

I’m still wondering why he sold the first car being as he spent so much money on it and it was so good.

Because I have a car allowance and it states the car is to be 4 years old max, it was six and becoming a financial liability.

I daresay just like OP’s last car-related thread there’s probably more to this than meets the eye…

    *yawn

The OP isn’t always up front with car threads https://singletrackworld.com/forum/topic/legal-advice-please-cancelling-a-new-car-dispute/

Until we know the other sides version, let’s not assume things are what they seem to be

See my comment above, they cocked up, but nice to see you’re happy to drag crap up from years ago to prove you’re judgmental

    Update:

Been to garage this morning, to be met by three people all apologising they’d got it wrong. They checked the CCTV, they could see that I did leave my keys with them whilst on the test drive and can see the sales girl check the outside of the car, but didn’t check the inside of it, or the mileage. They also accept they had at least three opportunities to have checked the mileage and didn’t, so they apologised unreservedly.

As soon as the log book for my old car comes back they’ll pay me the difference and case closed.

    geordiemick00
    Free Member

If they don’t check the Odo, on what basis did the girl type in 35k miles?

When I was asked about the details of my car she typed the details into her PC, they’re now claiming that I told her it was 35k, not 85k.

Would they not loose money as you now have the car and therefore would now be “Used”? Would they now stand to loose more money on the car if you returned it?

    Yep!

    geordiemick00
    Free Member

He can back his girl to the hilt all he likes, no one’s accusing her of anything more than a typo. Have you got the offer in writing?

I said the same, but they’re talking to me with real contempt like I’ve deliberately mis-informed her, which pisses me off more than anything as I know that’s not the case. Part ex value and settlement figure is mentioned on order form.

Have you got your new car or not?

Yes, picked it up today, they called me 4 hours after owning it to tell me about the ‘discrepancy’.

How much better was the valuation than you had in your mind – you must have had an idea?

It was about where I expected it to be, especially given they were looking to do a deal on a car they had to shift on and had lots of margin to play with due to the extensive list of options that inflated the RRP.

Sure it wasn’t a case of ‘don’t look a gift horse in the mouth’?

Nope. I’d been offered slightly more for a private sale, but the ease of handing it to the dealer and them paying off the finance was worth losing the £200 more I’d been offered privately.

Come on, are we not past the personal attacks on this forum still? Not really acceptable bud.

    Thanks, Airvent, much appreciated.

And this doesn’t seem to ring true – every car I’ve ever traded the sales person has sat in the drivers seat and turned the ignition on to check for warning lights etc.

Exactly! The trade in was in A1 condition and had full service history, new tyres all round, two new batteries and new control arm bushes, at the time they said it looked like a 3 year old car not 6 year old.

For the comments about ‘go to another dealer’…. I bought this car because it was built, ready to drive away and not subject to a factory order. I have a 14 day cooling off period with it, if the garage want to get arsey then I’ll hand it back and they can give me my Merc back and costs involved.

Low mileage cars are more hassle than high mileage.

The auto box will need a service by year 5 regardless of the mileage as fluids deteriorate with age regardless of mileage.

    As another perspective:

competitive virtue signalling is incredibly tedious and maybe a lot of us are tired of the same old posters trying to out-do each other with your oh-so-delicate liberal sensibilities

I used to regard myself as left-wing, being a lifelong Guardian reading liberal, but you lot, dear god….

    Everything anybody posts is racist/sexist/somethingist

Bed wetters doesn’t even begin to describe it. You inhabit some kind of alternative naval-gazing universe, stained with the butter drips from crumpets

Unless you express solidarity with the Palestinians twice in every post then you’re a fascist, apparently

It’s quite incredible the threads you derail with your tiresome, competitive self-righteousness and pious, sanctimonious pontificating

And you all act as a gang to shout down anyone who has the audacity to raise any opinion that wasn’t approved by the your messiah in Islington

Maybe you could try not polishing your halo so publicly for the benefit of all of us?

You might not be a fan of the Android OS driving the infotainment etc as there’s no Android Auto or Carplay support (yet).

This is a showroom car and has loads of extras, one thing that is included is the android/apple car play but it’s the outgoing infotainment system, not the new Google based on like the Polestar ones have.

It’s worth paying for the parking sensors on the front if they’re not included in the spec, as the bonnet is a long way away and isn’t forgiving of lazy parking. The autopark system (another optional extra) is very good and can get it in and out of space that would take me several attempts to do myself.

It has that with 360 cameras. We have that on the family E class Cabriolet and it’s good for checking if you’re about to kerb your alloys, but too slow to use as an actual parking method, only does 5kph max, can park it manually quicker!

Inclined to agree with other posters about the seats.

I noticed that myself, the petrol car I test drove had the basic ones and the car I’ve reserved has the all singing all dancing seats and they are poles apart, amazed they aren’t standard.

In the last year Volvo have stripped a lot of options and features from the V60 series due to the chip shortage. Check what you’re actually getting.

Which is why I’m not swapping my E class for another Merc! The chip shortage has hammered Mercedes and why the used prices have shot up, I paid £14k for my E class a year ago, put 25k on it and just sold it for £16k. This Volvo is in the showroom now and i’ve been right through it and it has just about everything, £7k of options on it which are all there, the pano roof, 360 cameras, full LED shadow lights, rear heated seats and ‘lounge’ 4 zone climate as well as Premium sound system and carplay/android etc.

Guys, I let this run for a few days as I knew there would be a ton of useful advice and at least one reference to my BIL, which still cracks me up to this day. (if you know, you know..)

I won’t reply to all the comments, there’s too many to reply to but a lot of them are suggesting things I’ve done, however, a lot of them are things I’ve done, made an impact and then stopped doing, example being using MFP/Nutracheck and lots of walking. This is probably the most success I’ve had in recent years and really should get back on it.

I’m also appreciative of the links to Alan Carr’s no sugar diet and the Mark Lewis YouTube channel, both of them resonate with me and will be following up on them.

I’ve spent a few days really drilling down on my life and it’s not a pretty picture, I think I’ve come to the conclusion that I’m a functioning failure, yes, you read that right. I have traits and parts of my personality I really don’t like. I have moments where I could probably tick some sort of depression tick list, but I never feel sad, however, my behaviour in the last ten years on many fronts has been super irrational.

I’ve had super unstable long term relationships, loads of jobs, grief that 4 years later I don’t even acknowledge and a very addictive personality. I’ve also come to the conclusion that at the age of 47, my diet is one of many things I need to sort out. I am a very popular guy, lots of friends, real good mates who have my back and helped me through some deep financial hardship and after having a few days deep in thought, I really think I’ve got an invisible back pack full of issues that have never really been addressed.

I seem to function well, £50k a year jobs and deliver good results for my employers, but always end up being sacked because my face doesn’t fit in due course, which is what happened mid 2020, it was a total kick in the knackers as I loved the job, got on well with all my peers, brought home £5m of business i was targeted and was very good at the job.

I’m starting to ponder if I have ADHD or Dunning Kruger Syndrome.

In the last 18 months I’ve been the broad shoulders for my partners 10 year old, who’s got mega behavioural issues due to the relationship she has with her own father, who is inconsistent and aggressive and this weekend went missing, found 300 miles away from home by the police. His dealings with her create a whole load of stress for us all and I relate to her as well as her dad due to my own daughter.

I have a 22 year old Daughter of my own back up home in North East who came back into my life after 7 years, I saw her for 14 years and then told to do one by her mum. She’s struggling big time and in the 6 months she’s been on the scene, I’ve given her thousands and drained myself emotionally trying to referee the bad relationship she has with her mum.

I think my food relationship is solely down to low esteem/energy and being damn lazy, I’m too busy sorting out everyone else’s issues as well as trying to function at a high level and NEVER addressing my own underlying issues and past.

Even typing this out to a load of strangers gives me some sort of peace of mind, that there are others with the same issues and a great community like this who have handled this topic sensitively. I thank you all.

    Off to the gym….

I suffer with this and tinnitus and to be honest, the training I had for tinnitus helped me a lot.

There’s nothing you can do, but mentally accept it’s something you can’t control, ‘tune it out’ of your range of hearing by distracting yourself with your own thoughts.

Did you have bad credit at one point OP with having the pay as you go meter in or was it that you have just moved to a house that was PAYG? I would be in touch with the regulator if its the latter.

No, I’ve just been offered a £50k car on finance. The house I bought was an ex rental and previous tenant had one fitted. It’s taken me nearly 18 months to have it swapped out to a smart meter then I can now swap supplier, it’s been a total nightmare. I had to complain to OFGEM as nobody would touch it.

BTW you do claim back your tax on the difference between HMRC 45ppm and your company 16ppm don’t you?

    Yes, factored in.

After 6 years on the allowance are you not in profit on the Merc?

Only had the Merc a year, but have buyer and it’s enough to pay off finance owing. last company had 7 year policy on company car.

Have you challenged the 4 year company policy?

My company does the same, but when I joined I got a concession from my boss because my car, although older than 4 years was very low mileage. They also weren’t going to miss out on hiring me on this policy point.

They’ve said they’d expect me to change this year as everyone else is in fairly new cars and get the same allowance. I have a good job and don’t plan leaving nor rocking the boat.

With that annual mileage I’d have gone the company car option so I wouldn’t have to worry about tyres, servicing and unexpected breakages etc especially with a car which must be over 100k mileage by now but I guess you have your reasons for going with car allowance. Also with that mileage I would have thought the personal lease costs of a vehicle will be eyewatering.

No company car option. Allowance only, they moved away from cars years ago as everyone wanted allowances. I’d prefer a company car and just suffer the tax, but the last three jobs I’ve had have all been allowances.

You obviously get a big allowance.

    FWIW I was getting £9.5k back in 2008, and 40ppm – now it’s £3.5k and 13ppm.

And that £3.5k is gross, so net is barely £150pcm – what you buying/running for £150 per month when it can’t be older than 4 years?

£650pcm + the AFR rates which are 16ppm Derv or 5ppm, then claim the tax back on the difference at year end.

Don’t spend a fortune and go through all the faff on the basis of a company policy that they possibly don’t enforce or care about.

I work for a small company with flat management, it was a condition of my employment.

What about contacting Ling for some advice?

I’ve asked my brother in law ;-)

Why does it have to be an EV (or a diesel)?

    It doesn’t

Just lease a petrol car for 3 years until EV prices have came down a bit, you can have some pretty amazing petrol cars for 50k compared to a pretty boring imo polestar.

Leasing is super expensive as it’s tied to an annual mileage and most want hideous deposits. I’ve stayed away from petrol for last 20 years as economy isn’t great for doing 20k+ a year. Admittedly, they are a lot better these days.

What would happen if you ignored the nudges and just carried on with the reliable car you have?

Not sure, I’ve already said to them if they want to fire me because of the age of my car then do so.

They have a perception that I’m making a killing on old car that is still financed to it’s value, I still have the liability of the finance in the event that I get laid off.

Companies attitudes to sales people and company cars in the last few years have really shifted. This company had a car sat idle for nearly a year and after that they then brought in car allowances. As usual, everything is always weighted in their favour, they even claim the VAT back on the fuel I buy ffs.

t’s a simple Cost Benefit Analysis, work it out, you have to get something again in 4 years by the sounds of it, so is it worth waiting until 2025/26 to see the benefit of moving to EV, we’re the same, would love to get a new car, but putting it off until we see some more funding/benefits kicking in for EV to make it more appealing.

That’s what I’m doing now. If EV’s can continue to enjoy a low Kwh rate to charge at home, it could make sense, but the energy market is too volatile. Even when diesel was £1.50 a litre, i was still getting near 50mpg from the merc and the 16p per mile would just cover it.

I looked at an A4 Avant, 2.0tdi 163bhp Black Edition earlier, £35k for a two year old one and the VED was £500 a year as the RRP was over £40k. So i have £2k of VED over 4 years, then servicing etc, whereas the Polestar has three years free servicing, no VED and no risk of any out of pocket bills like I have with a 6 year old 90k mileage car.

Have you have switched the cold water valve off on the boiler elbow? If nothing is coming out of the tap that’s what i would check first.

Second elbow from the right underneath the boiler.

It appears that I had switched this off!

Now, this appears to have been the only way I re-pressurised the boiler this morning. On all the manuals for the boiler is shows a filling loop, but the loop has no taps to turn, so I’m now melting my brain trying to remember how i’ve filled this in the past.

To be fair the boiler has been an absolute PITA and has had about 5 expansion vessels, which are a known weak point on these. It’s not cost me any money yet as it’s been covered by boiler care.

I repeat – get it serviced

    It’s serviced every year.

Reason for the post is to see if there was a simple solution before I ring the plumber and get the inevitable “I’m booked up for two weeks” comment.

Or the mid position valve. Take the actuator off the top and gently free the spindle by moving it with an adjustable spanner. Careful it only moves ~15deg each way.

Funny you should say that, my kitchen tap packed in today. The plastic splines on the tap handle snapped and now has mole grips on the tap spline, but nothing from any of the taps.

    Condensation drain frozen up?

Don’t think so, the pipe is inside the cupboard with the boiler and is warm as toast.

Being 6’5″ means forget a Transporter, the Kombi doesn’t have the bulkhead but has the same seat rail, the cockpit space is dire. Custom all the way, better VFM, as reliable, far more cubby holes and storage in the dash/doors and doesn’t have the ghastly overpriced image.

Go for 2018 onwards with the 170ps Panther engine, they’re really good and 30mpg is no bother.

    geordiemick00

They don’t get any tax relief. If they increase the amount they pay you from 15 to 20p they will be 5p out of pocket. If that affects their profits by 5p then in round numbers they’ll pay 1p less corporation tax, but still be 4p less well off. (and since many companies are measured on EBITDA (before tax profit) rather than net profit the shareholders will not be happy!).

YOU can claim tax relief on the difference between HMRC rate and company rate. Its a bit of a PITA but if your miles are high enough it will be worth doing self assessment to do this. You’ll only get tax back on the difference though – so for your first 10K miles that’s a reduction in taxable income of 30p/mile; if you pay 20% tax that’s 6p mile in your pocket, obviously better if you are a higher rate tax payer.

We’re looking at £2m profit this year on £14m turnover, we’re not strapped for cash. We have only a few shareholders and they’re happy because we’re growing very quickly, profitably and targeting to grow to £28m by end of 2023.

I’m just amazed they are so tight about the pence per mile being raised. I have to maintain my car and wait a year for a rebate, but they won’t pay a little more in mileage despite the fact i’m bringing in £500k of profit this year alone.

    geordiemick00

Ah, I think I’ve figured out what’s going on here. When a company pays you expenses, it’s covered by a dispensation from HMRC that means those expenses don’t get taxed – i.e you don’t pay tax on those payments. Under that dispensation, HMRC limits the amount a company can pay, to 45p a mile for private cars, or to an amount based on fuel type and engine size for company cars or those on a car allowance. This amount is updated as fuel prices change, but it’s always a bit marginal, and there is always a lag. So when HR says they cant claim tax relief, what they mean is that if they paid you more, you would be taxed on it, not the company.

They’re paying me 15p a mile, so for them to up that to 20p should’nt affect them. Tehy’ll claim tax relief on their 20p and i will on the rest up to 45p <10k 25p 10k> onwards.

My partner has a car allowance too and she has to submit VAT reciepts so her company can claim the VAT back on the business portion. My company aren’t interested, the FD says her finance team haven’t got time to add another process.

    geordiemick00

So my 2.0D rate went from 18p down to 11p. It’s supposed to be a level that flexes with rising and falling fuel costs but ultimately unless you are a super economical driver or have cheaper fuel then it’s barely enough to cover the mileage. Also obviously depends on where your driving is – motorway miles are fine but crawling around towns not so much.

I hava a Mercedes E Class E220d and I measured two trips. Trip A was a 220 mile motorway trip to the office, I got 51mpg and I was about £3 up on the repayment. Trip B was a 50 mile round trip into Manchester and back, I got £7.50 back and the car did 41mpg and it cost £8.20 in fuel based on the tank I’d just filled at the cheapest station which is now £1.42 a litre.

Soory guys, I think i haven’t explained my question corectly. I’m fully aware of all of the above.

My question is really, can the COMPANY reclaim tax/offset the 15ppm they pay me?

My HR woman is saying they can’t, so hence they want to pay us as little as possible and we claim the rest back from HMRC.

My argument is that if they CAN, then they should really be paying me a bit more. example being they pay me 20p per mile and clain their tax relief and I claim the relief on the other 25p/5p 10k onwards
