    i used waterfront bike shop on the lower west side a few years ago – they were fab although the bikes weren’t amazing – they showed me the quietest route up to central park and on to upper ny – was fab

    if it could be a neighbours it sounds like you need to discount it being on the bike (take it somewhere remote ish and repeat the scans)

    i have the 215j and it did get painfully slow so i replaced the hdd with an ssd and use that solely for the o/s (and keep the packages and services to a minimum) – then i have a 4tb external hdd plugged in via usb for vids and photos etc and it works perfectly

    the car is our theatre of war

    music – she likes tranquility, i like a rave (kids do too) – so music starts low then i use the buttons on the steering wheel to slowly but surely ramp up the volume – she absent-mindedly uses the volume controller (ok ok knob) to lower it – if challenged i claim (partly true) the car does it by itself as it gets faster. This goes on until she notices it’s got out of control at which point shel’ll press the knob to turn the stereo off.  We’ll sit in silence for 5 mins then when i go to turn it back on (the knob is the only way) she’ll (jokily, ish) slap my hand away.

    Also when she drives she says she uses the ratchet thing on the side of the drivers seat to raise it by 6 lifts, but if i lower it by 6 lifts the seat is no where near my driving position so when i challenge the 6 lifts thing she’ll then add about 15 other seat adjustments that change every time aaargh

    (edit just in case i use the car for work, she uses it very occasionally!)

    disruption from climate change is in the post for the vast majority of us – JSO are highlighting it – the courts are criminalising it – imo a harsh but suspended ‘we get it but the act is bad’ would’ve been fair – 5 years for it is uncalled for and isn’t a good look for the justice system (or irc)

    I’ve had similar – bulky item paid for and then not moved for ages – problem is it’s now their property and you are the caretaker (ie possibly liable if say you did roll it into the sea) – to deal with it you need a ‘charge’ (reasonable to a court) to off-set the cost – so for example you write via ebay (doesnt matter if they dont respond, you have it on record) that the car now needs to be removed and the removal quote is equal to or higher than the cost of the item and they have 2 weeks say to collect the car otherwise they will owe you money to cover the cost of removal etc – it worked for me but they did turn up in the dead of night on the last day.

    Why does this “we’ve maxed out the credit card” narrative persist?

    imo it’s because the government of the day are happy to allude to it to indicate the level of their appetite especially wrt borrowing – but the problem is that without a better analogy it is a gross simplification of the complexities of the system – especially wrt to growth

    …which is compounded by the general public then running with the analogy and simplifying it to spending money vs making money as per a credit card which dumbs it down to the point where it’s misleading.

    Like every complex system that’s dumbed down for newspaper and clickbait headlines the main reason it’s not challenged is that to challenge it you need to understand it properly which results in threads like these every so often – and the general public find them tedious and won’t buy a paper on the back of the discussion.

    So in the end it’s not in the interests of the newspapers and media to challenge it, in fact it’s in their interests to run with it and mislead and make people feel something by reading the headline (worry/panic etc) enough for them to buy the paper and read the nonsense in the article/thread

    that whole northern fringe of white mountains is full of tamer bike paths/lakes/trails – komoot was great for those – I got the basic map and winged it each day – it’s like snowdonia foothills on steroids (scale and size tbh)

    loved it there – did a circuit biking and hiking around white mountains – cranmore and loon both excellent (although came a cropper at cranmore so mtb cut a bit short) – bit less ‘harsh’ than rockies but the americans know trails – then hiking lafayette (ridge) was epic – mt washington weather turned and almost killed me (predictable) – depends where you start from but i did  airbnb’s in campton franconia then north conway – really good tap room/ micro breweries too – loved it – would go again in a flash

    I had similar and raised a case with citizen’s advice, their answer (below) is thorough and v good imo – and the short version is yes you potentially have a case for ‘loss of bargain’ (although I’ve had a lawyer friend say it’s aka ‘loss of chance’ ) but in the end for me it looked like too much hassle and I took their advice and never frequented the retailer again (a given in your case). Either way here’s the long version from CAA – you asked! and good luck!

    Note – the Loss of bargain bit is a few paragraphs down but you need the whole text for the complete picture.

    Your rights and obligations:

    When a consumer enters into a contract with a trader by means of a distance communication (telephone, internet, mail order etc.) they will generally have cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. These regulations, which we abbreviate to the ‘ICAC’ regulations came in to effect on 13th June 2014, and the cancellation, or ‘cooling off period’, starts when the contract is entered in to and generally ends at the end of the 14th day from the day after the goods are received; or the consumers’ cancellation rights have been received in a durable form; such as letter, email etc.

    The ICAC regulations also require the trader to provide pre-contract information in durable form, which should explain what you purchased, how much you are expected to pay, what are your cancellation rights and instructions on how you can cancel. If no such information has been provided; the consumer could hold the trader in breach of contract and pursue them for a full refund regardless of whether you received the goods or not.  You can read more about the ICAC Regulations here.

    In addition if the trader failed to honour the original agreement by sending you an incorrect order then you may hold them in ‘breach of contract’.  What you may seek is dependent on the severity of the breach –

    – if the breach is serious, you may seek to end the contract and claim a full refund;

    – if the breach is minor, it may be more appropriate to claim a partial refund that reflects the nature of the problem.

    Please note, by offering you a full refund the trader could be seen as reasonable, because you will be put back into pre-contractual position.

    You would not have to accept such a position and could pursue the trader for ‘loss of bargain’ if they refuse to provide the goods and/or services for what you consider is, the agreed price.

    When seeking ‘loss of bargain’ you would be looking for a refund of any amount already paid and to then recover any extra charges you might incur in buying or booking the same product elsewhere.   This is because no one can force anyone to perform an act they are not willing to perform, but they can pursue them for an amount of damages (money) that would reflect any costs they have incurred as a direct consequence of a breach of contract.

    In practical terms this can be difficult, because you would be expected to demonstrate that have you have found exactly the same product for the best possible price; however it could be used as a lever to negotiate with the trader, in order to try and reach an amicable compromise.

    When two parties to a civil dispute cannot reach an amicable compromise; the claimant would need to consider escalating their claim which could lead to civil court action.  Ultimately only a court can decide what, if anything you are entitled to and order the trader to provide that redress.

    In regards to a poor customer service; although there is no excuse for poor customer service, there is no legislation dictating the level of service a consumer can expect from any trader.

    As such, we often suggest to any consumer which feels they have suffered poor customer service to take their future custom elsewhere. This is because many retailers rely on return custom in order to run a profitable business; therefore any trader not demonstrating decent standards of customer service would hinder their own ability to run a successful business.

    sounds rough although I would communicate with them – gentle chat or a letter – worst case you walk away and that doesn’t really help anyone, and the status quo doesn’t look healthy either. I’d have a chat in a ‘I’m close to needing to get space and this why’ type of chat – non-confrontational – sometimes you’ve got to put yourself first (especially when you’ve not been doing so for so long).

    ah yeah didn’t think that through – at least it was the cropped version ;)

    The docs advice was to keep it moving (hence the sling and no cast nowadays) – so I was on my ss around town within a few weeks and bridlepaths within a few months – I took the view of push it quite hard and use painkillers quite a lot as I’m not going to make it worse unless I fall off again.

    Like I say the only regret was binning the physio too early – they were focussed on getting it straight again basically by forcing it with weights which also made it clear they wanted to push it really hard – one exercise was straighten arm as much as poss, then hold on to a 10kg dumbbell and let the weight straighten the arm for 10 mins. Also an elastic strap to straighten it, they may as well have stuck it in a vice and got the staff to jump on it. Looking back it explains why I binned it off.

    If honest it did take quite a few more months to be ‘back to normal’ but I managed around it. Blimey 4 years ago now, it was defo annoying and took a while but I’d advise getting on with everything asap.

    in fact I’d go as far as to say

    have zero pain when I don’t move my arm even without pain killers. But I can’t rotate my hand more than 10deg without excruciating pain in the forearm yet still quasi none in the elbow. Makes no sense to me.

    is exactly what I had for about 4 weeks but with a constant dull ache in the forearm muscle too

    sounds very similar to mine – fractured elbow right at the start of lock-down (wheelies fwiw) – sling for about 4 weeks but it got boring – I had a decent ache in my forearm for most of that time – I suspect it was the ramification of nerve damage from the impact – also when I rotated my wrist it would click a lot and could get excruciating (crepitus I seem to remember where ligaments/tendons are rebuilding) – I was supposed to do physio which I sacked off and regret – my left arm still can’t go as straight as my right (bit annoying for pointing in the correct direction ;) ) – basically ymmv but I had all of what you have, I could use my arm ‘reasonably well’ after 4 weeks and it took a few months for me to forget about it. Painkillers for when it hurt a lot but if you’re worried get it checked.

    Watched The Greatest Night in Pop on NF last night, doc about the recording of We Are The World.

    Highly recommended: fascinating and heartwarming – and left me full of admiration for Quincy Jones and Lionel Richie in particular.

    totally agree – richtea in particular – what a top bloke – and found bob dylan’s awkwardness funny too…

    fab bike – just swap out the wheels and tyres asap – they’re the weakest link – stock wheels are about 2200g/set when you can get wheels that are 1600g/set for less than £300 – been some wheel bargains recently too

    in hospital for an MRI for a back injury – considerable pain so on some decent painkillers – told to go to a cubicle down the corridor to remove clothes and put on a gown and to return to the waiting area, so remove clothes, put on the gown but being not entirely with it I put it on like a coat (wrong way round so somewhat exposed) – and then got confused about where the waiting area was. Turns out I’d wandered towards the geriatric ward and was found by a stern nurse who gave me a second gown to put on the correct way round and ‘escorted’ back to where i was supposed to be.

    call his bluff and go large – tell him that given it’s the best work you’ve ever seen you are inviting professors from oxbridge to come and evaluate him for genius qualities and early entry, and that you have scheduled him to give a q&a in front of the school so anyone can ask questions about his prowess and amazing writing and knowledge skills – and you’ll get the press in to cover it for the local news – invite his parents too – it really is outstanding work that needs to be rewarded

    Selling stuff ‘with the original box’ can get more money than selling an item ‘loose’ – perhaps by more than the cost of buying the matching box separately and putting them together – perhaps there’s a market for it and the seller knows it (is my guess) – they don’t seem to be hiding that it’s a box only.

    I say this as a mate bought (and sold) individual lego pieces and boxes, rebuilt the entire sets of high-value sets from the constituent parts and made good (ok ish) money – there’s a lego ebay site (brick link) etc so it could be similar

    zero to low emotional loss

    hmm I’m torn on this – when my oo up there was taken I was annoyed – I liked the bike even though it was battered and worth £30 say – but if I replaced it with something out of a skip I’ve changed my ‘pub bike’ for a ‘piece of junk’ that I literally don’t care about so in a way it ceases to be a ‘pub bike’

    a local scumbag once stole my singlespeed onone pompetamine from the front garden, was gutted, later that day I’m walking to the shops and spot it leaning unlocked against a lampost – proper toe-rag/junky idiocy – even after they’ve nicked it they don’t want it – that’s my definition of a pub bike right there
