Hi in Nov 2019 my wife was employed as a deputy manager in a nursing home to cover for maternity leave, she worked along side the pregnant one until she went on leave at the end of Fed 2020. the girl my wife is covering for has had the baby, her 9 months paid and taken leave and her 12 months is up at the end of Feb this year.

The girl is asking to take all of her 5 weeks accrued holiday in one lump, company policy/contract says only 2 weeks allowed with out MD's authorisation which he has refused, not surprising given the current situation in our nursing homes. She is refusing to say when she will return to work and has openly stated that she is willing to take things further if she is not allowed to have her 5 weeks holiday.

To make things a little more problematic, soon after the baby was born she went back to her parents in Italy and for some reason cant get back to the UK.

Any ideas on where this is going to go?

The wife has been offered another position elsewhere in the existing company and another outside this one but with a pay rise.

Not sure what you are asking really

As regards the woman who has been on mat leave. the company are in the right but not being flexible. I have my doubts she will return anytime soon or even at all.

For your wife - the position elsewhere in the same company should be held for her as long as she is needed where she is. the external position? pay is not everything. Quality of care homes is so variable as is what is expected of the managers. For example one home I applied for a job for wanted me to be on call 24/7 one week in two for no pay

So to chose between the two companies for me it would depend very much on how each treats its staff and patients

Its fairly common to use up accrued holiday before coming back- this is 2020 holiday so if she doesn't take it she'll have double the amount to use this year. Most places I've been at just see it as an additional period to the Mat leave absence and they start with a massive backlog.

Not really an issue for your wife to worry about if she's not the new mum's supervisor.
