she calls her brother to come and pick her up, the keys are on the passenger floor, so [i]maybe[/i] she really wasn't going to drive? she was drunk while sitting in a car waiting for a lift............

Why was she sitting in the driver's seat if she was waiting for a lift? Sounds like a big steaming pile of shite to me.

Oh I dunno - maybe it is crap, maybe it isn't

Although, I do spend an awful lot of time sitting in a car waiting for something or other & for some reason I always sit in the drivers seat - I'm sure it'd be more comfortable in the other seat but it doesn't cross my mind to move over

Seems fair enough. Could have been a bit more secure by putting the keys in the boot, but that would depend on keyless access to it after the event.

Sounds like she knows the law well and used her knowledge to avoid prosecution, did she intended to drive? Only person who truly knows that is her.

'Her own' would be her colleagues in the Crown Office and Procurator Fiscal Service, who prosecuted her.
