yes “they” can deviate from the guidelines (downwards or upwards!) if there is a justification.

But exactly as you said, it has to be justifiable. They can't arbitrarily give the first bloke a higher penalty because he rocked up in ripped jeans, and the second lass a more lenient one because she had a great rack.

They can deviate from the baseline dependent on circumstances but they can't just start making shit up. English law is build on precedence, question one is "what did we do last time" and question two is "how is this any different".

If she has stolen the car, was being chased by the Police, run multiple red lights at at least 50mph, was smoking weed, and done it all before she will be ok, just a £50 fine and and a telling off by the judge

(Well that’s my expert opinion from watching Police Interceptors)

I did 50 or so in a 40 limit just after lockdown, I was picking up a bike in York, never heard of a 40mph limit before so did 50

I'm really hoping that a crucial part of that story somehow got missed in the typing......

I'd never heard of a 20 mph limit before so I just assumed it was National speed limit and did 60.

My kid's school was not impressed.

The signs don’t speak, you have to look at them. The 40 mph limits are those with 40 on them.
