    Hello and yet again I require the input of much appreciated advice on a work related situation.

    As some of you are aware I had a pretty rubbish 2013 and I did have some time out of the work place (approx 2 months) which I was truly thankful for. In November 2013 a complaint was filed and from that day I’ve been on a suspension.. Basically the complaint doesn’t have any grounds really and I’m not at fault.

    But i do believe that the company (manager) is using this as a way to gross misconduct me from the work place which is fine if i had done something wrong.. its does however become a little more in depth but for reading purposes trying to keep it simple.

    Basically I’ve been on a lot of medication that make me sleepy and I’ve had to see psychiatrist etc etc as they believe i got a few issues.
    this was then relayed to my employer which did not take the advice of their governing body = ATOS

    Now back in November my boss said he was unable to dismiss me because he needed to seek a medical review from ATOS and my GP,but and that I was to be suspended and not allowed to enter the property until this had been sorted.
    My GP still not done the review but i do have a follow up with Atos on the 27th.
    But my manager wants to see me this coming Monday to get me to return to work.

    I’m more than willing to do this but a part of me thinking why the sudden change one minute his got all guns out and the next his asking how I am and hassling for me to come back (which I’m OK about)

    but what I’m not OK about is that they have already breached a review for my health and safety (GP, Atos advice) and now he wants to cut corners by returning me without the advice that he once set for me to do..

    Basically do i just suck it up and go back happily. or say I’m not happy in returning until I’ve sat the medical review on the 27th

    I would expect your company to ask you to undertake a medical, or at least meet with an occupational health specialist. You need to chase your GP to provide your report.

    Take in a union rep or a colleague you can trust with you on Monday, if your manager refuses walk out of the meeting. You’re allowed a form of representation.

    The company had me sit a medical earlier in the year which basically said that I was to undertake certain duty’s which at first did not happen but after a complaint with my health specialist they did sort themselfs out for a while.

    until it went wrong..

    Now they are trying to pin the blame on me (I do have a paper trail)

    But it just feels that the manager has looked into my case a little more realized him and his staff are at fault and he has not ground to fire me on now trying to cut corners by getting me to return early without first seeking another medical

    Are you still on a sick note from the doctors? If so, you can’t return to work without a fit note.

    @bruders – tell them you are happy to return to work (I think this is what you said) but you do need the medical stuff completed. I would also drop them a note that says you have done nothing wrong regarding this incident explaining in general terms why (don’t be too specific at this stage (and the fact that they seem to be trying to say it was your fault is causing you distress (which it is)

    As damacus said.
    I went back a week in to a two week sick note & they sent me straight to my docs.
