Driver claimed she didn’t see her. Elbow clipped by wing mirror.
Bike in for inspection suspecting bent mech hanger.
Scratches and bruising but no real damage.
    What to do next?
Trying to get to the cop shop to file some paperwork into the ‘can’t be arse’ folder.
Am I being pessimistic but the driver was a solicitor.

When it comes to driving everyone can make mistake.

I wonder how that will stand in the court “I did not see her” 10 points!

I doubt it’ll make any difference that the driver is a solicitor; all bad drivers are essentially immune

Driver claimed she didn’t see her.

ie admitted driving without due care and attention.

Unless she rides nude (in which case, this thread is useless etc..) I’d expect there to be damage to clothes as well as the bike? You’ll need reimbursing for replacing those, and if there was any sort of head impact when she fell, a new helmet even if there’s no visible damage. If Mrs Simmo needs the bike for work etc. and can’t ride due to it being damaged I’d think the driver’s insurance should be coughing for some taxis too.

If anything, the driver being a solicitor might help. Dragging out court/police action against them cant be good for their professional reputation.
The main thing is, your wife is basically OK.

Be grateful shes ok, buy a new mech hanger, give her some TLC and move on?

GLad she is ok which is the MAIN thing but not you need to be compensated for your out of pockets costs due to their actions.

IMHO contact the solicitor directly saying i assume you are accepting liability and we can deal with this amicably

the bike repairs are x and the clothes will be X

    Thanks

I imagine/hope they will pay up

Any witnesses or anyone hear her accept liability?

Maybe I’m a cynic but a solicitor? He’ll know all the tricks of the trade, good luck there.

I know that when the wife of a policeman hit my wife’s car head on with her motorbike & wrote the car off nothing happened, absolutely nothing. I have very little faith in the system.

Hope she’s OK mate and not put riding. Sid of a thing to happen.

Report to the police for the stats at least and so that it’s recorded, you never know the driver might have been there before.

    Also I didn’t see you, means I didn’t look.

Not necessarily Mike, it’s been done before but worth a read if you’ve not seen it.

What an RAF pilot can teach us about being safe on the road

Wonder how this would pan out as a defence?

I’ve seen it before but as a fast defence from a driver I always take it as didn’t look properly. In general hitting another Road user will be frowned upon.

Yes that RAF article just proves she didn’t look.

Make sure you are seen – wear bright colours & use a rear flashing light.

You can’t make sure you are seen.

You can’t make sure you are seen

You can improve your chances though by wearing high viz gear

‘didn’t see you’ is just an automatic defence.
I find those that say that did indeed see you but thought they could get away with their particular manoeuvre anyway.
Hope the OP’s wife is feeling better this morning.

I’ll leave the hi-viz argument for another thread.

The RAF article is good, isn’t it? Mind you, I’ve been out on the bike, had a driver make eye contact and then pull out anyway…

No she did look but didn’t process the rider.

other then the bruising and scratches hope your wife is ok. My opinion for what it’s worth is to report the incident to the police, you should be able to do this on the non-emergency number. It would help in gathering statistics to support better education, laws and infrastructure.

No she did look but didn’t process the rider.

By not looking, a glance left and right isn’t looking.

There are lots of reasons why people don’t ‘see’ bikes. Personally, I reckon an awful lot of it is them looking in the wrong place. Hora’s roundabout incident being a classic. The driver gets to the junction without scanning the road they are approaching. They then stop (or prepare to give way) and look down the road where they expect a car to be. The problem is, the bike is in front of them. On my commute there is a particular junction that I can practically guarantee this will happen. I always make sure that I don’t arrive the exit at the same time as the car driver, because 90% of them are looking 50 yards down the road & not at me.
