the gf got a speeding ticket recently - 39 in a 30 zone. she was picking it up from the garage after it failed its MOT, is declared as being off-road (SORN) and she has no insurance...

I'm fairly sure youre allowed to take your car back home, even if it has failed its MOT.....

The MOT thing is probably fine, the no insurance isn't. If the police do a check then that may well be an additional fine/points.

My experience is that all the various depts do not always have as much contact with each other than you think.
If you have since sorted the MOT etc you will be fine.

BFITH - As I understand it you are allowed to take it to an MOT test centre for a pre booked test but that's it.
If it was a fixed camera, pay the fine quick and hope.

I'm fairly sure youre allowed to take your car back home, even if it has failed its MOT.....
It's the driving without insurance I'd be more worried about. There are expections for driving without an MOT, as you say, but never for insurance.

yeah it was a fixed camera so we're hoping that the police & dvla wont cross reference and it'll just be a fine & points. we're scrapping the car now anyways.

If they'd done all the relevant checks, I imagine the NIP would have mentioned no tax/insurance. Pay up, send the license in and hope for the best.
Alternatively - and in no way do I endorse this course of action - are you insured for the car? Even 3rd party via your own car insurance would do. You take the points and your gf owes you BIG TIME. Insurance companies generally aren't too bothered about the first 3 points on a license, so I wouldn't worry about it putting your premium up.

I would imagine that being declared SORN and having it on the road isn't going to go down well. I dint imagine that there'll be MOT related dispensations for that.

Even 3rd party via your own car insurance would do.
If your insured to drive all cars third party as part of your insurance on your own vehicle, you're still not allowed to drive another car that doesn't have it's own insurance cover. You're not allowed just to get in to any un-insured car and drive it.

a few minor things really, bit of corrosion on the chassis being the worst. the NIP does mention about a possibility of cross-referencing for insurance but they evidently haven't done so yet.
i don't have an insurance policy so me taking the hit is out of the question.

i got done for no road tax, dvla camera (car was out of MOT and uninsured) - i only got done for the lack of road tax

Not sure about this. My insurance policy allows me to drive ANY car, whether it's insured by someone else or not. I'm just not allowed to leave it anywhere other than private property, due to the fact that as soon as I get out it's no longer insured and so can't be left on a public highway. i.e. I could legally drive my neighbour's uninsured car from his drive to the MOT station.
