By that I mean do I really need it to pass.? I have failed the mot on it. There is a broken connection somewhere. I can’t be arsed chasing wires round and old car. The normal ones work just fine. Can I just diconnect the thing.?

Whether its disconnected or just not working, its a fail.

Also not sure of the rules if you fully remove it.

it doesn’t work and you failed. if you disconnect it it won’t work either. my deduction is, you’ll fail again. i could be right though.

Think that if it exists, it has to work. Consider running a fresh wire up from another brake light so that it works for the MOT test?

My MOT tester said if I told him that I had disconnected it he would pass it. If I knew the bulb/leds had failed he wouldn’t.

I too was told that if it was there, it had to be working.

Fadda and Molgrips are right.

But if you haven’t got one at all. It’s not a fail. I guess it’s thought that if you have one there the driver following you may be paying more attention to that than the other brake lights.

I was pulled over at traffic lights and given a friendly warning by a friendly policeman once because my bike rack was obscuring mine – its one of those high racks delibrately so it doesnt obscure the main lights!

If it’s not connected, then they can’t fail it, but you really need to show that it is disconnected. What car is it?

From the testers manual –

Additional stop lamps
Any additional stop lamps fitted and connected must be tested. Where extra lamps are fitted and there is doubt as to whether they are connected, the benefit of this doubt should be given to the presenter

High level stop lamps
These are lamps usually fitted in the rear window or boot spoiler of a vehicle and may consist of a number of light sources .
At least 50% of the light sources must illuminate

However, a high level brake light is classed as an additional light with regards to the MOT. Plod and insurance can still do you for it not working though.
