@fizzicist – but your company is not suing them for not working their notice per se but breaching non-compete clauses.

As mentioned earlier it is very difficult for a company to prevent an employee from continuing to work in their profession. I would fight any attempt to prevent me from working with a competitor on the basis that I need to earn money and there are only so many companies I can work for given the particular sector I am involved in and they would all be deemed competitors.

However, I would not approach my current company’s customers for example as that is enforceable or use inside knowledge of my current company’s products, systems etc as again that is something they can have you for.
