    Tractor driver cut me up not long before pulling in to the site he was working on, I went in and reported it to the foreman, obviously pissed off at the time. I’ve now calmed down a bit and called foreman to clarify I’m not baying for blood, don’t want him to get in serious shit (unless he has previous), I just don’t want it to happen again and want the company to warn him to take more care around vulnerable road users. Foreman told he he has given him a stern verbal warning but he works for a different company and would need to bring it up with them to go any further. Foreman reckons ticking off is possibly the right thing in this situation and bloke is “a good lad normally”

    Thing is if driver has done this before the foreman won’t know about it, if he does it again at a different site they have no record of it – so what to do?

    Is foreman covering for his worker, fobbing me off and trying to get me to drop it?
    Am I being overly harsh getting it reported to his employer?
    I told him I’d have a think.

    If you do report it and he hasn’t got a history for it then he will just get a warning or something but if he does have history then they might take further action (depending on how they treat such incidents) so you have nothing to lose and keep a clear conscience. That is what I would do in this situation.

    I’d say you wish to discuss it with his employer to be honest. In a vehicle like that he should know better. If you do nothing further and there is an accident there shortly with someone else how would you feel?

    Seems to me that you’ve done all you could/should. If he has history and his employers have done nothing about it after this incident, it’s not you who should be having sleepless nights if he hurts someone next time.

    so 2 all* with, it has to be said, the “report it” side actually stating reasons

    I think I’m going to contact the employers (initially without details) and find out if they have a proper driver review/record procedure in place in which case it would be useful to report, if all they are going to do is bollock him again and then forget about it then there’s not really much point.

    Tricky one. Normally with motorists I go for the ‘let it go’ approach as not much happens and there far too many idiots on the road to let every one bother you. In this case the chap was at work so there is more chance of something being done and more reason for the employer to deal with it. If you report it, they do nothing and he then injures someone the HSE should be down on them pretty heavily. Its up to the company to put measures in place to protect the public.

    Fair chance you’ve been fobbed off, they’re all having a laugh about “those ‘king stupid cyclists, get what they deserve over” their lunch.

    But not much else you can do unless you want to go through the written complaint approach.

    Its amazing how many tractor drivers i see on their phones.. yes a generalisation but seems like a very high percentage

    But you already have reported it.

    You are simply not sure whether appropriate action will be taken. Short of sitting in his disciplinary hearing and checking his HR file has been correctly updated, you will never be sure.

    Personally a written complaint should result in a formal response and at least a record being placed. Its one of those the foreman may be telling the truth- he is decent he did bollock him, but they may just be laughing at you over some tea, racism and porn, who knows.

    If it is a large company with an official policy they will take it seriously if a written complaint and they will care about their reputation….possibly.

    Not clear from the OP but was it a building site? If so speak to the main contractor (builder) etc. and report a near miss. This will have to get escalated as an H&S issue. They are legally required to record these.
