    BUT…

    Richards, of Wesley Close, Charmouth, was also charged with driving whilst uninsured, which he denied. The prosecution will be offering no evidence for this offence.

    WTF does that mean? They couldn’t be bothered to prepare the evidence? Either he was or wasn’t insured at the time?

    He admitted the careless driving charge and had no licence, I imagine the prosecution took the view that the “no insurance” charge wasn’t worth pursuing and wouldn’t add to any sentence. It could also have been a part of a plea bargain.

    Richards remains disqualified from driving

    You’ve just reported that the stupid **** hasn’t got a driving licence, how does he “remain disqualified”?

    Googlefu is weak today can’t find any other info than driver ran into the back of a cyclist, hope there was more to it than that, or has the CPS gone for the easy careless driving charge instead of the more suitable dangerous? (again!)

    Sometimes a prosecution team will decide not to pursue one or more of the charges because it would be pointless. I did a case recently where we dropped one of the 2 charges – we could prove both but it saved time and the facts of the dropped charge were used again in the sentencing so even through the defendant ended up guilty of one offence he got the punishment that he would have gotten if both cases went forward.

    Every case is different and the way defence and prosecution act can seem really odd if you don’t know the details of the case, especially the legal discussions the public won’t ever hear.

    you can be jailed for causing death by careless driving but if he claims momentary inattention yeah he’ll probably avoid it.

    He is disqualified from obtaining a licence, either full or provisional.
