  • Does anybody here have a good understanding of DPA and Subject Access Request?

    A person I know was referred to Occupation Health following a three week absence from work due to depression. The first instance of absence in 8 years at the same company so the actual referral was a surprise.
    When at the 3rd party Occupational Health office, the person concerned was shown on the computer screen the referral that was made, in full. The OH person couldn’t understand why the referral was made but was also concerned by the content of the referral in that reference was made to organisational things that had nothing to do with the person referred.
    There was one thing in the referral that stood out (and now were getting to the crux of the matter). It was suggested, in no uncertain terms that the person referred was failing dramatically in their role.
    It is fair to say that this is absolutely, without question NOT the case.
    So, seriously concerned by this, the person concerned made a Subject Access Request at their place of work as they wished to challenge the comments made in the strongest possible way.
    Now, the document that was given to the person concerned following the SAR did not resemble the referral that was made to OH in any way, shape or form!
    It would appear that the manager who made the referral has comprehensively altered the original document!
    I can’t think for one minute this is legal! The OH department are posting a copy of the original referral to the person concerned and both copies will in the first instance be shown to the area union rep.
    Does anybody have any knowledge of what the potential outcome of this could be? The person concerned is extremely angry about this but isn’t sure they would want the manager to lose their job or be prosecuted if that’s the likely outcome?
    TL:DR
    A manager has falsified an OH referral from the referral that was submitted and it is about to be taken to organisation’s CEO and union. Any idea on what the outcome could be?
