No, not "poor old Saddam". Nuremberg established that waging aggressive war, "is not only an international crime; it is the supreme international crime, differing only from other war crimes in that it contains within itself the accumulated evil of the whole." So Saddam despite receiving full support and encouragement from the US for attacking Iran, was guilty of "the supreme international crime" and therefore deserved the death sentence.
