    Is there any debate over whether that is careless driving or not?

    In all likelihood, if it does go further, it will be charged as without due care and attention. The drivers fine and costs will probably be less than the cost of repairs to the bike. Which would have to be pursued through civil courts. Or a hard fight with the insurance company.

    Sad reflection of our times.
